課程概述

The topic of the lecture is the general idea and the principle institutions of (any) insolvency law, illustrated by norms from the insolvency laws of Germany, England and the USA.
§ 1 Introduction (Insolvency proceedings, Insolvency)
§ 2 Parties involved (Debtor, Creditors, Procedural bodies [court, Insolvency Practitioner])
§ 3 Commencement of proceedings (Initiation, Preliminary measures, Prerequisites for the opening of insolvency proceedings, Costs)
§ 4 The estate
§ 5 Effects of the opening of insolvency proceedings (Effects on the estate, Effects on contracts, Effects on trials, Set-off, Effects on the debtor, Effects on creditors)
§ 6 Transactions avoidance
§ 7 Rights and ranking of creditors (Ordinary creditors, Secured creditors, Preferential creditors, Subordinated creditors)
§ 8 Special proceedings (Debtor-in-possession proceedings, Insolvency plan, Reorganisation proceedings)
§ 9 Personal insolvencies and discharge
§ 10 Cross-border insolvency
